Not Medical Advice

ProIEP does not provide medical diagnoses, treatment recommendations, or medical advice. Our service analyzes IEP documents but does not replace consultation with healthcare providers, psychologists, therapists, or other qualified medical professionals regarding your child's health or developmental needs.

AI Limitations

Our analysis is powered by artificial intelligence, which may make errors. AI-generated recommendations should be reviewed critically and verified with qualified professionals before taking action. We cannot guarantee the accuracy, completeness, or applicability of AI-generated content to your specific situation.

Agreement to Terms

By accessing or using ProIEP ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Description of Service

ProIEP provides AI-powered tools to help parents understand and analyze Individualized Education Programs (IEPs). Our services include:

  • IEP document analysis and plain-language explanations
  • Goal quality assessment using SMART criteria
  • Service comparison tools
  • IEP jargon translation
  • Anonymized district comparisons (with your consent)

User Responsibilities

By using our Service, you agree to:

  • Provide accurate information when creating an account
  • Upload only IEP documents for which you have legal authority (i.e., your child's IEP)
  • Review redacted content before uploading to ensure personal information is properly removed
  • Use the Service only for lawful purposes
  • Not attempt to circumvent our security measures or PII redaction system
  • Not use our Service to harm, harass, or discriminate against any person or entity

Data Ownership

You retain ownership of all documents you upload to ProIEP. By uploading documents, you grant us a limited license to:

  • Process and analyze your redacted documents to provide our Service
  • If you opt in: use anonymized data to improve our AI and provide district comparisons

You can delete your data at any time through your account settings. See our Privacy Policy for details.

Intellectual Property

The Service, including its original content, features, and functionality, is owned by ProIEP and is protected by copyright, trademark, and other intellectual property laws. Our AI analysis tools, algorithms, and district comparison databases are proprietary.

Subscription and Payment

Some features require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as described at time of purchase
  • Automatic renewal unless cancelled before the renewal date
  • Provide accurate payment information

Refunds: We offer a 30-day money-back guarantee for new subscribers. Contact us at support@proiep.com for refund requests.

Referral Program

Our referral program allows you to earn credits by inviting friends:

  • You earn $10 in credit when a referred friend makes their first purchase
  • Your friend receives $10 in credit upon signup
  • Maximum earnings: $50 (5 successful referrals)
  • Credits cannot be exchanged for cash
  • We reserve the right to modify or terminate the program at any time
  • Abuse of the referral program (fake accounts, self-referrals) will result in account termination

Limitation of Liability

To the maximum extent permitted by law:

  • ProIEP is provided "as is" without warranties of any kind
  • We do not guarantee specific outcomes from IEP meetings or school negotiations
  • We are not liable for decisions made based on our analysis or recommendations
  • Our total liability is limited to the amount you paid for the Service in the past 12 months
  • We are not liable for any indirect, incidental, or consequential damages

Indemnification

You agree to indemnify and hold harmless ProIEP and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.

Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. You may also delete your account at any time.

Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Santa Clara County, California.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through our Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
